Legal Assistance

Question:  What specific services can the Legal Assistance Officers perform?

Answer:  They can handle problems, including:

    Debtor/creditor relations                                      Contracts

    Landlord/tenant relations                                      Notarizations

    Domestic relations                                                Wills and powers of attorney

    Immigration and naturalization                               Consumer affairs

    Tax information                                                    Insurance

The Legal Assistance officer cannot handle the following:

    Private income-producing activities

    Representation in civilian courts

    Representation concerning prosecution under the UCMJ

Question:  What about preparing a will prior to deployment?

Answer:  Your Legal Assistance Officer can assist you in preparing a will.  Please see him/her PRIOR to your spouse's deployment.  A will is needed to dispose of property and provide for minor children's care in the event of your death or the death of your spouse.

Question:  What is a Power of Attorney (POA)?

    Are there different types of POAs?

    Do I need one for a deployment?

Answer:  A Power of Attorney is a document with which the soldier authorizes another person (husband, wife, parent) to act on the soldier's behalf.

  • A General POA grants authority over all of the soldier's personal affairs.
  • Soldiers being deployed may only need a Special POA, which will:
  • ØAuthorize another person to take possession, operate, and/or register a vehicle

    ØAuthorize hospital or medical care for dependent children

    ØDispose of certain property

    ØReceive and cash pay checks
